The effects of changes in the local Plan

In connection with the adoption of local land use plan may change as the possibility of exploitation and management of real estate. The change in the way of use may rely on the fact that the use of property in the way (in accordance with the intended purpose) is impossible or severely limited. This is in response to changes in the property or part thereof, for example, building on the right of free development, for public purposes, such as the route to water, sewer. The consequence will reduce the value of the property.

The owner or user (there is no such powers such as the lessee, tenant, or user) shall be made in accordance with Article. Paragraph 36. 1 and par. 2 of the Act of 27 March 2003 on planning and developing space, Dz. U. 2003 No. 80 pos. 717; hereinafter - upz), to require from the municipality:
- compensation for actual injury suffered, or
- to purchase real estate or a part thereof, or
- convert the property to another.

These requests are not limited to any term (see below), so that they can be reported in each period of the local plan.

When the value of the property have deteriorated, and the owner or perpetual user did not request one of the tasks mentioned above, in the event of disposal of the property may require compensation of equal value parcels reduction (Article 36 paragraph. 3 upz).

The result of the changes relating to its use and management of real estate may also increase the value of the property.In a situation where the value of the property increased, and the owner sells the property, Mayor (mayor, president) gets a one-time fee (the so-called pension planning) in the amount specified in the local plan for land use as a percentage (see art. Paragraph 15. 2 points 12 upz ). The fees can not be higher than 30% increase in the value of the property.
It is important that in order to be able to talk about the effect of reduction or increase in the value of the property must be satisfied:
- change in value of real estate must be made in connection with the change or local adoption of the plan and
- dispose of the property before the expiry of 5 years from the date of entry into force of the plan or its amendment.
